The Delaware Personal Data Privacy Act (DPDPA) is a data privacy regulation designed to enhance personal data protection for Delaware residents. Effective January 1, 2025, the act sets forth specific rights for individuals and obligations for businesses regarding data handling and security.
The DPDPA applies to:
- Entities that conduct business in Delaware or target products or services to Delaware residents.
- Businesses that control or process the personal data of at least 50,000 Delaware residents annually or
- Entities that derive significant revenue from the sale of personal data and process data of at least 25,000 Delaware residents.

Delaware residents are granted the following rights under the DPDPA:
- Access: The right to access their personal data held by businesses.
- Correction: The right to request corrections to inaccuracies in their personal data.
- Deletion: The right to request deletion of their personal data.
- Data Portability: The right to obtain a copy of their personal data in a format that is structured and commonly used.
- Opt Out: The right to opt out of the sale of their personal data, as well as its use for targeted advertising and profiling.
