The New Hampshire Consumer Data Privacy Act is a data privacy law designed to enhance personal data protection for New Hampshire residents. Effective January 1, 2024, the NHCDPA establishes rights for individuals and imposes obligations on businesses regarding the collection, use, and protection of personal data.

The NHCDPA applies to:

  • Businesses that operate in New Hampshire or target goods or services to New Hampshire residents.
  • Entities that control or process the personal data of at least 50,000 New Hampshire residents annually or
  • Businesses that derive significant revenue from the sale of personal data and process data of at least 25,000 New Hampshire residents.

 

NHCDPA Guidelines

New Hampshire residents are entitled to the following rights under the NHCDPA:

  • Access: The right to access their personal data held by businesses.
  • Correction: The right to request corrections to inaccuracies in their personal data.
  • Deletion: The right to request the deletion of their personal data.
  • Data Portability: The right to obtain a copy of their personal data in a format that is portable and transferable to another entity.
  • Opt-Out: The right to opt out of the sale of their personal data, targeted advertising, and profiling.

Businesses that meet the criteria for NHCDPA must 

  • provide clear and comprehensive privacy notices detailing data collection, processing, and sharing practices.
  • conduct assessments to identify and mitigate risks associated with their data processing activities.
  • implement reasonable security measures to protect personal data from unauthorized access and breaches.
  • ensure contracts with data processors include provisions that enforce NHCDPA compliance.
  • seek explicit consent before processing sensitive data categories, such as health information or biometric data.

  • notify affected individuals of data breaches within 60 days of discovering the breach. The notice should include details about the breach, the types of data involved, and steps taken to address the breach.
